1. ACCEPTANCE OF TERMS By creating an account, accessing, or using "Your AI Game Master" (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must immediately cease use of the Service. You represent that you are at least 13 years of age. If you are between 13 and 18 years of age, you represent that you have reviewed these Terms with your parent or legal guardian and have their consent to use the Service. 2. SERVICE AVAILABILITY, SERVER SHUTDOWN & MODIFICATIONS 2.1. "AS IS" and "AS AVAILABLE". The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise. We do not warrant that the Service will be uninterrupted, error-free, timely, secure, or free from bugs or vulnerabilities. 2.2. Right to Terminate or Discontinue. We reserve the absolute right at any time, with or without prior notice, for any reason or no reason, to temporarily or permanently modify, suspend, shut down, take offline, or discontinue the Service (or any part or feature thereof). You acknowledge and agree that we shall have no liability or responsibility to you or any third party for any modification, suspension, downtime, or permanent cessation of the Service or its servers. 3. DATA RETENTION, USER BACKUPS & EXPORT RESPONSIBILITY 3.1. No Cloud Archival Guarantee. The Service is not an archival, permanent data storage, or backup service. We make no guarantees that your saved games, characters, campaigns, inventory, adventure logs, lorebooks, user settings, or any other data will be stored securely or permanently retained. 3.2. Data Loss and Database Modifications. We reserve the right to modify, migrate, or reset databases, servers, and data schemas at any time. Data may be lost, damaged, corrupted, or permanently deleted as a result of software updates, technical failures, server crashes, security incidents, or site shutdowns. We assume no responsibility or liability for any lost or destroyed user data. 3.3. User Responsibility to Export Data. You are solely responsible for routinely exporting, backing up, and preserving your own character data, campaign history, and adventure logs to your local storage or external devices using the export features provided within the application (e.g., character export, adventure log export). We have no obligation to retrieve, restore, or compensate you for any lost data. 4. USER CONDUCT AND PROHIBITED ACTIVITIES You agree not to use the Service to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or sexually explicit. Furthermore, you strictly agree to the following: 4.1. No "Jailbreaking" or Adversarial Prompts. You shall not attempt to bypass or undermine AI safety filters, reverse-engineer model instructions, "jailbreak" the system, or submit adversarial prompts designed to elicit prohibited content or reveal underlying prompts and architectures. 4.2. Advertising Integrity. You shall not engage in any "invalid activity" regarding advertisements displayed on the Service. This includes, but is not limited to: (i) clicking on advertisements for the purpose of artificially inflating revenue; (ii) utilizing bots, automated scripts, scrapers, or proxies to click ads or interact with the Service; or (iii) encouraging or soliciting third parties to click on advertisements. Violation of this clause will result in immediate and permanent account termination. 4.3. System Abuse and Exploits. You shall not attempt to overwhelm our servers, bypass rate limits, probe security vulnerabilities, or automate requests to the Service outside of approved user interfaces. 5. INTELLECTUAL PROPERTY & GAME RULES 5.1. Your Inputs. You retain ownership of the original text prompts and inputs you submit to the Service. You grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, and process your inputs solely to operate, debug, monitor, maintain, and improve the Service. 5.2. AI-Generated Content. To the extent permitted by applicable law, we assign to you any ownership rights we may hold in the text generated by the AI in response to your prompts. You acknowledge that AI-generated content is generated probabilistically, may not be copyrightable, and may resemble outputs generated for other users. 5.3. Third-Party Game Systems & SRD 5.1. "Your AI Game Master" is an independent project and is not affiliated with, endorsed by, or sponsored by Wizards of the Coast LLC or Hasbro, Inc. Game mechanics and rules provided in the Service utilize the System Reference Document 5.1 ("SRD 5.1") under the Creative Commons Attribution 4.0 International License (CC-BY-4.0). 6. FEES, SUBSCRIPTIONS & NO-REFUND POLICY 6.1. Free Tier. The Service offers a Free Tier with usage limitations (such as weekly action limits and ad-supported features). We reserve the right to alter, reduce, or restrict Free Tier features and limitations at any time without notice. 6.2. Premium Subscriptions. We offer paid "Premium" recurring subscriptions that unlock enhanced capabilities (such as increased action limits, advanced features, ad-free experience, and PDF exports). 6.3. Billing Authorization. By purchasing a subscription, you authorize us (via our third-party payment processor, Stripe) to charge your designated payment method on a recurring periodic basis (e.g., monthly or annually) until you cancel. 6.4. Cancellation. You may cancel your subscription at any time via the "Manage Subscription" section in your Account Settings. Cancellation will take effect at the conclusion of your current paid billing cycle. 6.5. Strict No-Refund Policy. All payments, fees, and charges are strictly non-refundable to the fullest extent permitted by applicable law. We do not provide refunds, prorated credits, or reimbursements of any kind under any circumstances, including but not limited to: (a) Temporary server downtime, connection errors, bugs, or maintenance; (b) Degradation of third-party AI models or latency; (c) Permanent shutdown, closure, or discontinuation of the Service or its servers; (d) Loss, corruption, or deletion of save files, characters, or campaign history; (e) Account suspension or termination due to violation of these Terms; or (f) Adjustments, increases, or modifications to token, action, or feature consumption rates. 6.6. Price Adjustments. We reserve the right to modify subscription pricing at any time. Any price changes will be communicated in advance and will apply to subsequent billing periods following notice. 6.7. Nature of Virtual Actions and Credits. "Actions", "Tokens", "Boosts", "Energy", or other virtual units provided, earned, or purchased within the Service represent a limited, revocable, non-exclusive license for personal entertainment use only. Virtual units possess no cash value, cannot be redeemed for fiat currency, are non-transferable, and are strictly non-refundable. 7. AI TOKENS, ACTION COSTS & DYNAMIC CONSUMPTION RATES 7.1. Dynamic Cost Adjustments. The Service relies on generative artificial intelligence, neural networks, and cloud computational infrastructure. We reserve the absolute right to adjust, modify, increase, or decrease the number of actions, tokens, or credits required to perform any in-game activity (including, but not limited to: narrative turns, voiceover audio generation, image and scene visualization, living world simulation ticks, or character generation) at any time, at our sole discretion, with or without prior notice. 7.2. No Locked or Grandfathered Token Rates. Subscribing to a paid tier or purchasing action boosts grants you access to an allocation of actions or compute under prevailing rates; it does NOT guarantee permanent, fixed, or grandfathered token exchange rates. As third-party AI provider costs, model architectures, context window sizes, and computational requirements evolve, action costs per feature may be rebalanced accordingly. 7.3. Acceptance Upon Playing, Registering, or Subscribing. By creating an account, subscribing to any paid plan, purchasing action refills/boosts, or playing the game, you expressly acknowledge and agree to these dynamic consumption mechanics. You agree that any change to feature costs, action allowances, or token burn rates shall not constitute grounds for a refund, chargeback, or compensation. 7.4. Fair Use and Abuse Prevention. We reserve the right to apply rate limits, concurrency caps, fair-use restrictions, or speed adjustments to any account exhibiting anomalous or excessive consumption to safeguard system performance for all users. 8. DISCLAIMERS, THIRD-PARTY DEPENDENCIES & AI OUTPUTS 8.1. AI Hallucinations and Accuracy. The Service utilizes third-party artificial intelligence models (such as Google Gemini). You acknowledge that AI models may produce inaccurate, fictional, nonsensical, biased, or unexpected responses ("Hallucinations"). The Service is strictly intended for entertainment purposes and should never be relied upon for factual, legal, medical, or professional advice. 8.2. Third-Party Dependencies. The Service relies on third-party cloud infrastructure, AI providers, and payment processors. We are not responsible or liable for any failures, interruptions, delays, outages, or sudden cessation caused by external service providers. 9. LIMITATION OF LIABILITY & INDEMNIFICATION 9.1. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL "YOUR AI GAME MASTER", ITS CREATORS, OPERATORS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 9.2. Maximum Monetary Cap. OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED UNITED STATES DOLLARS ($100 USD) OR (B) THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM. 9.3. Indemnification. You agree to defend, indemnify, and hold harmless "Your AI Game Master" and its operators from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Service, or any content you submit. 10. GOVERNING LAW AND DISPUTE RESOLUTION 10.1. Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. 10.2. Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be determined by confidential, binding individual arbitration rather than in court. 10.3. Class Action Waiver. YOU AND WE AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
